Again with antivirus and firewall turned off I was able to seamlessly update my 3GS to 4.1. It took approximately 20 minutes. No loss of data or settings. And thankfully no freezes or crashes of the computer or the phone.
iPhone Sync
So if anyone is having strange issues with their iPhone sync through a windows vista computer try closing your security during the update (of course shut off your internet connection during syncing to prevent evil things).
